PLAN AHEAD · WITH BALWYN LEGAL

Your Will. Your wishes.
Our guidance.

Start your Will from home, with a fixed preparation fee, a private draft by email and a solicitor’s final check before you sign.

One Will: $426.80 including GST. Lawyer review and amendments within the agreed scope included.

A straightforward Will, with personal support

Our service is for adults in Victoria with straightforward wishes. Tell us who you would like to appoint as executor, who should benefit from your estate, and whether you wish to nominate guardians for children. We help turn your instructions into a draft for you to review.

Our team handles your enquiry, questionnaire, payment link and draft delivery personally. To begin, email your name, preferred contact details and a suitable time for us to contact you. We will explain how to provide your detailed instructions privately.

The email button opens your email app. Please send only your initial contact details; keep identity documents, asset information and beneficiary details for the instructions process we arrange with you.

From first enquiry to signing

  1. Tell us you would like to begin. We check suitability, identity and conflicts, provide the questionnaire and confirm the scope and terms before accepting your matter.
  2. Pay your advance into trust. After acceptance, our team sends your individual Bank of Melbourne Pay by Link for $426.80. We start drafting when your instructions are complete and we confirm cleared funds.
  3. Read your first draft privately. We email your unsigned draft to the private email address you confirm. Reply with any changes, or tell us it is correct, and suggest dates and times you can attend our office for witnessing.
  4. Complete the solicitor check and office visit. A solicitor checks your Will after your reply and settles amendments with you. Our team confirms your appointment and the signing copy. Please leave your draft unsigned until that appointment.

When to speak with us first

Tell us about blended families, overseas property, business or trust interests, an intention to exclude a close family member, an existing inheritance dispute, or questions about capacity or pressure from another person. These circumstances may need advice beyond the straightforward fixed-fee service. We will discuss the scope and any different fee before you commit.

If the matter is urgent, call 1300 132 097 and explain the timing. Please give your own instructions.

Will service terms & payment

These terms apply to the straightforward online Will service described above and identified in our written acceptance. For this service, they take precedence over inconsistent general online-service wording on this website.

Your instructions and our acceptance

We check identity, conflicts and suitability before accepting your engagement in writing. An enquiry alone does not establish an engagement. Please provide complete, accurate information, give your own instructions and tell us privately if you feel under pressure. We explain any work outside this service and seek your agreement before undertaking it.

Fixed fee and advance payment

One Will for one person costs $426.80 including GST ($388 plus $38.80 GST). Preparation, solicitor review and amendments within the agreed scope are included. We explain what is included in your office visit and agree any additional cost before you commit.

After acceptance, we provide a matter-specific trust Pay by Link. Your advance is held for you in our general trust account. Drafting starts once your instructions are complete and we confirm cleared funds. If you are unsure about a payment link, call 1300 132 097 using the number on this page.

Drafts, review and witnessing

We email an unsigned draft to the private address you confirm. Read it and reply with corrections or confirmation, together with your preferred office attendance times. A solicitor then completes the final check and settles changes with you. We identify the signing copy, confirm the in-person appointment and explain the witnessing arrangements. Drafts are not ready for signing.

Billing and cancellation

When we send the first draft, we may bill for work already performed to the extent properly payable, identifying the work and amount on the bill. The fixed fee also includes the later solicitor check and amendments within scope. We account for the balance on completion; total charges for the agreed Will service will not exceed the fixed fee. We explain any proposed withdrawal from trust and follow the required procedure before applying funds to a bill.

You may ask us to stop at any time. If no chargeable work has been done, we return the full advance. Otherwise we explain the work, bill only fair and reasonable costs properly payable and return the unused balance to the person entitled to it. We seek your agreement before undertaking extra work.

Questions and agreement

Call 1300 132 097 with questions or concerns. You may request an itemised bill or contact the Victorian Legal Services Board and Commissioner. Your statutory rights are preserved. Before payment, we ask you to confirm that you have read and accept the agreed scope, GST-inclusive fee, advance and billing arrangements, and that you are giving your own instructions.
